Arranging insurance for domestic services is crucial both for protecting the rights of workers and fulfilling the legal obligations of employers. The insurance of household employees in Turkey is categorized into two groups: those who work 10 days or more per month and those who work less than 10 days. A new regulation has been in effect since April 1, 2015, concerning this matter.

Which Jobs Are Considered Domestic Services?

If someone other than the residents performs household tasks, it falls under domestic services. Those working in domestic services are protected by labor law. Thus, employers are obligated to pay the insurance premiums for these individuals. The jobs we are talking about include:

Elderly care
Patient care
Cleaning
Laundry and ironing
Dishwashing

Insurance for Domestic Workers Working 10 Days or More

Those working in domestic services for 10 days or more are considered fully insured under Law No. 5510 on Social Insurance and General Health Insurance. Employers must notify the Social Security Institution (SGK) using the "Notification for Employing Domestic Workers for 10 Days or More" form. The start date indicated on this form is considered the start date of the insurance. Employers are required to submit this notification to the nearest SGK office by the end of the month in which the work started.

In these insurance procedures, employers are not assigned a special workplace registration number. The records for domestic workers, such as house cleaners, daily cleaners, or live-in domestic workers, are kept based on the employer’s Turkish ID number.

It is also worth noting that individuals authorized by the employer can apply for insurance on behalf of the employer, provided they have a notarized power of attorney.

How Is It Calculated?

The employer’s insurance premium debt is calculated based on the number of days the worker has worked and their earnings. No monthly payroll is issued for this purpose. Employers can pay the premium debt by the end of the following month, provided there is no change in the employee's status. Employers must report the worker's gross earnings within the established minimum and maximum limits, and the premium calculation is based on this report.

Employers are also required to insure foreign workers in domestic services who work more than 10 days. In such cases, the foreign worker’s work permit must be attached to the notification.

Insurance for Domestic Workers Working Less Than 10 Days

Domestic workers who work less than 10 days per month are only insured for occupational accidents and diseases under the additional Article 9 of Law No. 5510. Employers are not required to submit workplace notifications, employment notifications, monthly premium and service documents, or termination notifications for these workers. A general notification is sufficient. Employers must notify the Social Security Institution using the "Application Form for Employing Domestic Workers for Less Than 10 Days." As long as the same worker continues, there is no need to submit a new form. 

The form must be submitted to the Social Security Centers by the end of the first business day following the work month (if the month ends on a weekend or public holiday). Additionally, it is possible to make notifications for those working less than 10 days through the e-Government portal (e-Services).

How Is It Calculated?

If daily cleaners or domestic workers work less than 10 days a month, the employer does not bear all the responsibilities. However, even if these workers work less than 7.5 hours a day, employers must pay a certain amount of occupational accident insurance premium for each day. These days can be spread across different days of the month. Those who apply using the "Application Form for Employing Domestic Workers for Less Than 10 Days" are required to pay a 2% premium for occupational accident and disease insurance. Employers can make these payments through bank branches or online via the e-Government portal.

Finally, workers themselves can contribute extra premiums to increase their retirement benefits.
